These Terms of Service (“Terms”) are a legal agreement between you and BARJANI regarding your use of our website and the purchase of our fragrance products. By browsing or purchasing from us, you agree to these terms in full.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

“Product Disclaimer”

Fragrance is a sensory and chemical experience. By purchasing, you acknowledge the following:

Olfactory perception varies by individual. BARJANI does not guarantee that a scent will match your personal preference or "smell" identical to a description on your specific skin chemistry.

SHIPPING & HAZMAT COMPLIANCE

Due to the alcohol content in our fragrances, BARJANI products are classified as Class 3 Flammable Liquids.

• Ground Only: Federal law requires our full-sized fragrances to ship via Ground Transportation. Expedited air shipping is unavailable for these items.

• Risk of Loss: The risk of loss and title for items purchased pass to you upon our delivery to the carrier.

• Delivery Estimates: Shipping times provided at checkout are estimates only. BARJANI is not responsible for delays caused by carriers or customs processing or due to any unforeseen circumstances.

• International: We are not responsible for any customs, duties, or import taxes applied to your order.

RETURNS & THE "SEALED BOTTLE" POLICY

To maintain the purity of our stock and the safety of our customers:

• Returns are only accepted if the original cellophane wrap and seal remain unbroken and untampered. Once a bottle has been "sprayed" or the seal broken, it is no longer eligible for return.

• Damages: Report any transit damage to hello@barjani.com within 48 hours of delivery. Please include photos of the damaged bottle and the shipping box.

HEALTH & SENSITIVITIES

While BARJANI complies with IFRA (International Fragrance Association) standards, we are not responsible for individual skin reactions.

• Ingredients: Full ingredient lists are available on our packaging. Review them for personal allergens.

• The Patch Test: We recommend a small patch test on the inside of the wrist before applying the fragrance liberally.

• Usage: Our products are for external use only. Avoid contact with eyes, broken skin, or furniture/clothing surfaces that may be damaged by alcohol-based liquids.

PROHIBITION OF COMMERCIAL RESALE

Products purchased from BARJANI are for personal use only.

• You agree not to resell, redistribute, or commercially exploit our fragrances (including "decanting" or selling samples of our liquid) without express written permission from BARJANI leadership. The unauthorized decanting, rebottling, or reselling of Barj fragrances is strictly prohibited and will result in legal action or a permanent ban from our store.

• We reserve the right to cancel orders that appear to be placed by dealers, resellers, or distributors.

INTELLECTUAL PROPERTY

All content on this site—including the "BARJANI" name, branding, bottle designs, photography, and scent descriptions—is the exclusive property of BARJANI. You may not use our brand assets for commercial purposes without our express written consent. Any unauthorized use of our trademarks or imagery is strictly prohibited and may result in legal proceedings.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, BARJANI shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products, including but not limited to skin irritation or damage to physical property.

To shop with BARJANI, you must be of legal age in your jurisdiction. We reserve the right to refuse service, or cancel orders at our sole discretion if we suspect fraudulent activity or a violation of these Terms.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Wyoming, USA.
